The “Darkening” Effects of Incarceration

Research has repeatedly shown that race, rather than being an immutable trait of individuals, is actually quite fluid and may change over time and by social context. In the February issue of the journal Social Problems (v. 57, #1), sociologists Aliya Saperstein (University of Oregon) and Andrew Penner (University of California, Irvine) report their analysis of data from the 1979 National Longitudinal Survey of Youth (NLSY), which demonstrates how incarceration affects convicted offenders’ self-perceptions of their race as well as others’ perceptions of their race (“The Race of a Criminal Record: How Incarceration Colors Racial Perceptions”). The NLSY asked a nationally representative sample of 12,686 young men and women (aged 14-22 years in 1979, when the survey began) a series of questions on a variety of topics, including their racial and ethnic identification; respondents’ race/ethnicity were also classified by NLSY interviewers. After the initial survey, participants were interviewed every year until 1994, when biennial surveying was initiated. In their intriguing and socially important study, Saperstein and Penner analyze NLSY data from 1979-2002 to see if participants’ own racial/ethnic identification changed and whether interviewers’ classifications of respondents’ race/ethnicity changed, depending on whether the respondent was or had been incarcerated in the intervening time period.

Without going into the complexities of the statistical analyses, which included numerous controls to rule out the effects of intervening variables, suffice it to say here that Saperstein and Penner found that NLSY participants who self-identified as European American in 1979 were significantly more likely to self-identify as black in 2002 if they had been incarcerated compared with those who had not been incarcerated. As Saperstein and Penner report, “these findings demonstrate . . . that incarceration leads to changes in racial self-identification and the effect operates primarily through making individuals see themselves as not quite white. To put this into perspective, consider that currently nearly 6 million people in the United States have been incarcerated . . . Based on our results, we would expect that more than 250,000 previously incarcerated individuals no longer identify as white as a result of their incarceration” (p. 103).

Saperstein and Penner also found that interviewers were more likely to change the racial/ethnic classification of NLSY respondents if the respondent was currently or had been incarcerated since the time of the last survey – and the change they made was to “darken” incarcerated respondents. That is, respondents who had been classified by interviewers as white prior to incarceration were more likely to be classified by interviewers as black once they were incarcerated.

Apart from further affirming the socially constructed nature of race, Saperstein and Penner’s study has, as they put it, “real-world consequences for racial inequality.” There is a good deal of research, some of which is cited by Saperstein and Penner, that shows that many white people associate black people, especially black men, with crime. This association is what underlies the practice of racial profiling by police, who, as I have pointed out on this blog before, target black neighborhoods for saturation policing, not surprisingly contributing to higher arrest and incarceration rates for blacks. This association also likely contributes to misidentification of criminal suspects by “eye witnesses,” thus resulting in higher erroneous convictions for blacks. I have also pointed out on this blog how incarceration contributes to poverty – especially poverty among black men due to their disproportionate incarceration rates – because a prison record lowers the likelihood of stable employment in a job that pays a decent wage. Saperstein and Penner’s analysis shows how “actual disparities in incarceration are exacerbated by stereotypical associations about the types of individuals who commit and/or are punished for committing crimes” (p. 110). Interestingly, more states are using early release of prisoners as a way to address fiscal crises, but as the Saperstein and Penner study reminds us, release from prison will do little, if anything, to reduce inequality; we must simultaneously address the invidious link between blackness and crime, not only in the minds of the general public, but also in minds of the formerly incarcerated themselves. Further research on why some people who have experienced incarceration change their racial identification from white to black and the meanings that race has for them, as well as for those who do not undergo this redefinition of self, would be most welcome.

Racist Attacks on President Obama: Early and Often

A blogger over at DailyKos (blackwaterdog) has raised a question I have been thinking about for nearly a year now. How is President Obama being treated differently than other presidents and leading white politicians?

He first notes the differential treatment by the mass media in regard to President Obama’s intense and innovative meeting this week with Republicans:

With anyone else, CNN wouldn’t dare go to commercials every time the president speaks, like they did during that summit on Thursday. They wouldn’t dare counting how many minutes George Bush or Bill Clinton were talking. Chris Mathews wouldn’t dare making an issue out of Ronald Regan calling members of congress by their first name. . . .They fully cooperate with the Right-Wing smear machine when it comes to president Obama’s national security performance – even if almost every independent and military expert actually thinks that he’s a terrific Commander in Chief.

Not just the white supremacists and extreme rightists have constantly quibbled about or directly disrespected our President:

On Thursday, almost every Republican had no trouble interrupting him in the middle of a sentence. They looked like they’re going to vomit every time they had to say “Mr. president”

Much has been made in various media about Obama being “professorish” and/or “arrogant,” but clearly this is a stereotyped way of putting down his distinctive intelligence and grasp of the facts on many issues, including health care. Many folks accuse him too of being

elitist (because he uses big words that they don’t understand). He is weak on national security (because he actually thinks about the consequences). He divides the country (well, he did that the day he had the audacity to win the election). Worst of all, he actually thinks that he’s the president.

The racist imaging has obviously come from the far right wing and white supremacists, but some criticism is also coming from the white left, which can be seen in the left political blogs:

. . . there’s also some hidden and maybe subconscious and disturbing underline tone behind some of the things . . . throughout the Left blogosphere…. “He’s weak, he’s spineless, he’s got no balls, primary him in 2012.”

Adia and I predicted some of this attack in our Yes We Can? Book, but it is already clear that we need to add a chapter to that book on how quickly and severe these attacks have become, and not much more than a year into his pathbreaking Presidency. What do you make of the many attacks on President Obama so far?

Judge to FDNY: ‘Pattern, Practice and Policy of Intentional Discrimination’

First, let me begin with a personal note about the FDNY.    I was in New York City when the terrorist attacks occurred on 9/11.  I was grateful on that day that my loved ones came home that day from working in lower Manhattan, shaken but not physically harmed.  I was so moved by the heroism, and devastating loss, to the FDNY (343 died) on that day — and so befuddled about what to do in the face of that overwhelming tragedy — that one of the things I did was what my people do when someone dies:  I cooked and delivered food.  Specifically, I cooked a huge batch of fried chicken and walked it over to the firehouse nearest my apartment.   I say that to let readers know that I have a tremendous respect for the day-to-day heroism of firefighters and the work that they do.  And, yet, in watching all those funerals for firefighters after 9/11 it was impossible not to notice how overwhelmingly white and male the FDNY remains.    The racial composition of the fire department is no accident.

A judge in New York ruled that the FDNY had engaged in a deliberate “pattern, practice, and policy of intentional discrimination.” Back in July, 2009, Judge Garaufis  ruled that the FDNY used a test in 1999 and 2002 that had a discriminatory effect on black applicants.   In his ruling on Wednesday, January 13, 2010,  the judge found that the city intentionally discriminated against blacks in using those tests and in ignoring calls over the years to change the testing procedure. The suit was brought by three people who took the test and by the Vulcan Society, a fraternal organization of black city firefighters.

Legal experts said the decision was the first in recent memory in which a court had found that the city had intentionally discriminated against a large group of people in the workplace.  There is also evidence that those at the highest levels in city government, including (former) Fire Commissioner Nicholas Scopetta and Mayor Bloomberg, were aware of this “pattern, practice and policy of discrimination” at the FDNY and did nothing to stop it, although the judge’s ruling stopped just short of holding them legally responsible.   However, the judge did write that he found strong evidence to suggest that they were made aware numerous times that the Fire Department’s entrance exams were discriminatory, yet failed to take sufficient remedial action. Mayor Bloomberg testified at a deposition in August that he “did not recall” receiving a report more than six years ago warning him about sharp differences in the pass rates between white and minority candidates for firefighter jobs.  Part of what is so remarkable about this decision is that it is one of the few court decisions in recent memory that finds there was racially discriminatory intent, rather than simply a disparate-impact.

The New York Times article quotes Paul Washington, 48, a firefighter in Brooklyn and a former Vulcan Society president, who said that the ruling validated “what we’ve been saying for the longest time, and which I’ve been saying since 1999 — that the Fire Department discriminates, intentionally, and they just continue to do it.” Washington says he believes that over the department’s 145-year history, there were probably “thousands of thousands of black men and women who should have had this job and didn’t get it.”

Washington’s comment in the NYTimes highlights gender discrimination, not addressed by this court decision.  Make no mistake, the FDNY has also systematically and intentionally discriminated against women over its 145-year history.  The story of Brenda Berkman  illustrates how difficult it is even for women with white skin privilege who still face gender discrimination.   Berkman is a white woman who sued the FDNY and eventually became a Captain in the Fire Department,  There is an excellent documentary by Bann Roy about Berkman, called “Taking the Heat.” The film also touches on the struggle of black firefighters and includes some interviews with members of the Vulcan Society.

Federal Judge Garaufis struck a blow for racial equality with this decision, but the FDNY has a long way to go before it will be an equitable organization in practice.   Until that time, the kind of excessive valorization of firefighters that goes on – perhaps especially in this city – will always be a bit tempered for me by the knowledge that this particular form of on-the-job heroism is only available to a few, white men.

“All human beings are born free and equal in dignity and rights”. These first few famous words of the Universal Declaration of Human Rights established 60 years ago the basic premise of international human rights law. Yet today, the fight against discrimination remains a daily struggle for millions around the globe.

“Our main objective is to help promote discrimination-free societies and a world of equal treatment for all,” says the High Commissioner [Navi Pillay] who this year will mark Human Rights Day in South Africa. She encourages people everywhere – including the UN family, governments, civil society, national human rights institutions, the media, educators, and individuals – to seize the opportunity of Human Rights Day 2009 to join hands to embrace diversity and end discrimination.

The realisation of all human rights – social, economic and cultural rights as well as civil and political rights – is hampered by discrimination. All too often, when faced with prejudice and discrimination, political leaders, governments and ordinary citizens are silent or complacent. Yet everyone of us can make a difference. You are encouraged to celebrate Human Rights Day by advocating non-discrimination, organizing activities, raising awareness and reaching out to your local communities on 10 December and throughout 2010.

Human Rights Day [examples]:
South Africa: * Students from around the world will take part in the first World Human Rights Moot Competition organized by the University of Pretoria with the support of the OHCHR. They will argue a fictional human rights case on the principle of non-discrimination before the High Commissioner presiding over a panel of high level judges. New York: * UN Secretary-General Ban Ki-moon will open, “Race, Poverty and Power: A Panel Discussion on Discrimination in Development” (PDF). This event will provide a forum for a critical examination of the relationship between ‘race’ and development.

… All human rights work can be viewed through the non-discrimination lens. It prohibits discrimination on the basis of race, colour, gender, language, religion, political or other opinion, national or social origin, disability, property, birth or other status.

I have recently summarized some relevant history here:

The struggle to deal with the Nazi Holocaust, together with ongoing struggles for human rights by people in many countries led to the pathbreaking Universal Declaration of Human Rights adopted in late 1948 by the United Nations General Assembly with no negative votes and eight abstentions. This important international agreement stipulates in Article 1 that “all human beings are born free and equal in dignity and rights,” and in Article 7 that “all are equal before the law and are entitled without any discrimination to equal protection of the law.” Article 8 further asserts, “Everyone has the right to an effective remedy…for acts violating the fundamental rights,” and Article 25 states that these rights extend to everyday life: “Everyone has the right to a standard of living adequate for the health and well-being of himself and his family, including food, clothing, housing.” Since 1948 numerous international covenants on economic, social, and political rights have been signed by most United Nations members, and agencies like the UN Commission on Human Rights have been established to monitor human rights globally. The UN International Convention on the Elimination of All Forms of Racial Discrimination (CERD), put in force in 1969, specifically requires governments to make illegal the dissemination of ideas of racial superiority and the operation of organizations set up to promote discrimination. This convention, first ratified by some nations in the 1960s, was ratified by the United States only in 1994. Today CERD commits the U.S. and other governments to “adopt all necessary measures for speedily eliminating racial discrimination in all its forms and manifestations.”

In the mid-1970s two additional agreements–the International Covenant on Economic, Social and Cultural Rights (ICESCR) and the International Covenant on Civil and Political Rights (ICCPR)—were approved by many countries and added to the Universal Declaration of Human Rights to create an what is often termed an International Bill of Human Rights. However, while the ICESCR was signed by the U.S. government in 1979, it has not yet been ratified by the U.S. Senate. The U.S. Senate did ratify the ICCPR in 1992, but with fourteen reservations, declarations, and understandings, so many that much of that Covenant was thereby invalidated for the United States. Nonetheless, these United Nations covenants represent major international responses to, as Judith Blau and Alberto Moncada suggest, “genocide, oppressive labor practices, the antiapartheid movement, national independence movements, liberation movements of colonized people, and atrocities committed against civilians” and to the “civil rights movement in America, the feminist movement, and the newly empowered voices of indigenous groups and landless peasants.”

Racist Employment Practices in a Recession

The New York Times has a useful article touching on some recent research on discrimination in employment against black workers with college degrees:

College-educated black men, especially, have struggled relative to their white counterparts in this downturn, according to figures from the Bureau of Labor Statistics. The unemployment rate for black male college graduates 25 and older in 2009 has been nearly twice that of white male college graduates — 8.4 percent compared with 4.4 percent. Various academic studies have confirmed that black job seekers have a harder time than whites. A study published several years ago in The American Economic Review titled “Are Emily and Greg More Employable than Lakisha and Jamal?” found that applicants with black-sounding names received 50 percent fewer callbacks than those with white-sounding names. A more recent study, published this year in The Journal of Labor Economics found white, Asian and Hispanic managers tended to hire more whites and fewer blacks than black managers did.

The focus seems to be just on black men. But black women also face much racial discrimination, as well as gendered-racist discrimination in workplaces, doing business, and elsewhere.

The journalist adds this about the well-educated black men featured in the article:

It is difficult to overstate the degree that they say race permeates nearly every aspect of their job searches, from how early they show up to interviews to the kinds of anecdotes they try to come up with. “You want to be a nonthreatening, professional black guy,” said Winston Bell, 40, of Cleveland, who has been looking for a job in business development

The article reports that many black men hide their racial identity in their resumes because that reduces the discrimination, at least initially, against them.

Not once in the article, however, are the main and major perpetrators of this employment discrimination, mostly white male managers and executives, featured as the central creators of this deep U.S. problem. There is a tone here and there of “they say race permeates,” which softens the analysis of racism. There is of course much evidence and research such journalists could have examined on the white racist framing in the heads of many white executives, whose racialized thinking and action out of that framing needs to be the center of such stories. Such racist practices are old, foundational, and systemic. For even the more “liberal” analysts, yet, they still mostly get presented as episodic and/or tacked on to an otherwise unproblematical society, with white perpetrators seldom problematized.

Madonna and European Racism: The Roma (“Gypsies”)

The Associated Press has a story about 1000s of Romanians booing Madonna at a Bucharest music concert, where she criticized discrimination targeting the Roma (Romani or “Gypsies”). The story reports that at first Romanian fans applauded Roma musicians who performed with her, but the crowd of 60,000 changed dramatically when she

condemned widespread discrimination against Roma, or Gypsies — and the cheers gave way to jeers.

There are at least half a million Roma in Romania. The AP report noted the large scale of this racialized discrimination, which human rights agencies report is probably greater than for any other racial-ethnic group in Europe:

Sometimes, it can be deadly: In neighboring Hungary, six Roma have been killed and several wounded in a recent series of apparently racially motivated attacks targeting small countryside villages predominantly settled by Gypsies.

The scale of the everyday discrimination is indeed huge and extensive:

Nearly one in two of Europe’s estimated 12 million Roma claimed to have suffered an act of discrimination over the past 12 months, according to a recent report by the Vienna-based EU Fundamental Rights Agency. The group says Roma face “overt discrimination” in housing, health care and education.

And this anti-Roma framing and discrimination is reinforced at the top:

In May 2007, Romanian President Traian Basescu was heard to call a Romanian journalist a “stinky Gypsy” during a conversation with his wife.

The violent discrimination extends to Hungary, Bulgaria and other European countries as well:

Human rights activists say the attacks in Hungary, which began in July 2008, may be tied to that country’s economic crisis and the rising popularity of far-right vigilantes angered by a rash of petty thefts and other so-called “Gypsy crime.”

According to wikipedia

The Roma suffer the worst health conditions in the industrialized world together with some of the worst health problems associated with the third world. Rates of both infectious and non-communicable diseases are high. The proportion of Roma living in poverty exceeds 75% in countries throughout the region.

Wikipedia also describes widespread racialized discrimination across Europe, including today in western and southern Europe:

Amnesty International reports continued instances of Antizigan discrimination during the 2000s, particularly in Bulgaria, Romania, Slovakia, Hungary, Slovenia, and Kosovo. Romanies are often confined to low-class ghettos, are subject to discrimination in jobs and schools, and are often subject to police brutality. In Italy, the government recently declared that Italy’s Romani population represented a national security risk and that swift action was required to address the emergenza nomadi (gypsy emergency).

Interestingly, researchers have found that the Roma’s ancestors likely immigrated out of south Asia (India) about the 11th century, and they have been racialized in Europe and the United States since at least the explosion of racist science in the 19th century:

Later in the 19th century, Romani immigration was forbidden on a racial basis in areas outside Europe, mostly in the English speaking world (in 1885 the United States outlawed the entry of the Roma) and also in some South American countries (in 1880 Argentina adopted a similar policy) . . . . The persecution of the Romanies reached a peak during World War II in the Porajmos, the genocide perpetrated by the Nazis during the Holocaust. In 1935, the Nuremberg laws stripped the Romani people living in Nazi Germany of their citizenship, after which they were subjected to violence, imprisonment in concentration camps and later genocide in extermination camps. The policy was extended in areas occupied by the Nazis during the war, and it was also applied by their allies, notably the Independent State of Croatia, Romania and Hungary.

Somewhere between a half million and 1.5 million were killed by the German Nazis and their allies in eastern Europe during the World War II era.

Even after fifty generations in Europe there is still this widespread racialized oppression. In addition, the AP report also noted contradictory responses in Europe today to the Roma, with very negative and discriminatory responses in most cases but more positive responses to some of their culture, especially to “Gypsy” dance and music cultural styles. This reminds me of the way that many/most white Americans “enjoy” certain kinds of African American and Latino music and dance, even as they persist in widespread racial discrimination against these U.S. groups. In racially framed worlds, here white-European, people considered to be “of color” are often OK “in their place.”

Antiracist Organizations: Resources for Fighting White Racism

Typical of the range of current antiracist organizations are the People’s Institute for Survival and Beyond (PI) and Antiracist Action (ARA). Located in New Orleans and created by African American activists, PI is a community-oriented group that sets up “Undoing Racism” workshops mostly to train people in community and nonprofit organizations. These multiracial workshops have now trained thousands of people, including many whites, since the 1980s. They are designed to help officials in various organizations and community activists to better understand white racism, to understand and value cultural diversity, and to show people how they can “undo racism” in their own lives and organizations.

Taking a somewhat different tack, the substantially white ARA groups, about 200 as of now, have worked aggressively against racism in numerous cities in the United States and Canada. Originally established to combat neo-Nazi and Klan-type organizations, ARA groups have developed other antiracist programs. For example, their Copwatch program has attempted to reduce police brutality by having members take video devices into the streets to record police actions in their dealings with citizens of color. Eileen O’Brien has a very useful book, Whites Confront Racism, in which she compares members of these two important antiracist groups, from field research interviews.

In addition, dozens of groups called the “Institutes for the Healing of Racism” regularly hold seminars and dialogues on issues of racism in numerous U.S. and some overseas cities. These multiracial groups work locally to heighten the awareness of racism, educate citizens about how to fight racial hostility and discrimination, and provide dialogue across racial group boundaries. These groups have dealt openly with racist framing and institutional racism in their own lives and areas. Check out the National Resource Center for the Healing of Racism.

While their objectives have varied, yet other antiracist organizations have also pressed for changes in systemic racism over the last few decades. A brief sampling includes the Dismantling Racism Program of the National Conference (St. Louis), the Anti-Racism Institute of Clergy and Laity Concerned (Chicago), the Northwest Coalition Against Malicious Harassment, the Southern Empowerment Project, and the Committee Against Anti-Asian Violence.

Note that a number of these antiracist organizations, as well as established civil rights groups like the NAACP and Urban League, have played important roles in openly countering the racist accusations and racist attacks that have been made against President Barack Obama and in helping to secure his election as president in 2008.

Police Brutality and the National Political Agenda

The Root ( a Scales Of Justicevery good source on racial issues) has a recent post by Sherrilyn Ifill, University of Maryland law professor and civil rights lawyer, on the continuing reality of police malpractice and brutality, most of it directed against men of color—most especially, black men (Creative Commons License photo credit: srqpix). She begins with the sad “talk”:

It’s one of the depressing ironies of black life that in the Obama era, black mothers and fathers must continue giving their teenage sons “the talk.” I’m not talking about the birds and the bees. I’m talking about the “how to act when the police stop you” talk. Rule 1. Don’t talk back to the officer. Rule 2. It doesn’t matter if you weren’t doing anything wrong. Rule 3. And this is critical, don’t reach for your wallet without asking the officer first. Supplemental rule. Carry a pink cell phone if you can. A black cell phone may look like a gun to a nervous cop.

She lists some of the many police killings in the last couple of years, such as brutal taser death of Baron Pikes in Winnfield in 2008:

Tasered nine times within 14 minutes by a 21-year-old white officer, Pikes may well have been dead – handcuffed and unresponsive in a police cruiser—when the last two 50,000-volt charges were delivered directly to his chest. The officer reportedly admitted that he began using his Taser on Pikes when the handcuffed black man responded too slowly to the officer’s demand that Pikes get up and walk to the police car.

Then mentions others like this one:

In Dallas, 23-year-old Robbie Tolan, a minor league baseball player and the son of former Major League Baseball player Bobbie Tolan, was shot in his own driveway in an affluent white suburb on New Year’s Eve. White police officers, purportedly believing that the SUV driven by Tolan and his cousin was stolen, approached the young black men and ordered them to lie down on the ground. The car belonged to Tolan’s parents, and the officers reportedly did not identify themselves. When Tolan’s parents came outside to find out what was happening, one of the officers allegedly shoved Mrs. Tolan against the garage. Robbie Tolan yelled to the officer to stop pushing his mother, and that, witnesses say, is when he was shot by one of the officers.

She notes a Youtube video of

The recent case involving the cell phone video of a drunk, white, off-duty police officer in Erie, Pa., making crude jokes about a black murder victim and ridiculing the victim’s grieving mother, illustrates part of the problem.

We have discussed some of these major instances of police brutality on this blog numerous times.

In conclusion, Ifill makes this on-target comment:

The results of these incidents are depressingly predictable. Outrage. Marches. Most often no indictment. Sometimes an indictment. Always an acquittal. More marches. Next incident. The stunning lack of change suggests that our protest-oriented approach to police brutality must focus less on punishment for individual officers, and more on systemic institutional changes within our police academies and departments.

Just how systemic the police harassment and brutality is can be seen in polls and in social science research. For example, one 2001 Gallup poll found 83 percent of black respondents had experienced racial profiling in the last year. In addition, in a 2007 Gallup poll a fifth of the black respondents reported that had suffered discrimination at the hands of police officers, a proportion that has increased in recent years.

Lest some think that we are ignoring lots of white victims of police brutality here, we might note that one social science study back in the 1990s analyzed 130 police-brutality accounts in several cities across the country. In that reviews of cases, criminologist Kim Lersch discovered that the targets of this type of police malpractice are almost always black or Latino. The latter made up 97 percent of the victims of police brutality, while the overwhelming majority (93 percent) of officers involved were white. Police brutality overwhelmingly involves white-on-black or other white-on-minority violence. (See discussion in Chapter 5 here.)

Anti-Latino Racism: SPLC Report on Discrimination

Do white discrimination and the white racist frame still target Latinos, both immigrants and the US-born? You bet they do, according to a large-scale research project by the Southern Poverty Law Center, Under Siege: Life for Low-Income Latinos in the South. Researchers recently interviewed 500 low-income Latinos, especially immigrants, in Nashville, Charlotte, New Orleans, rural Georgia and several towns in Alabama.

The poignant report begins with personal stories:

In Tennessee, a young mother is arrested and jailed when she asks to be paid for her work in a cheese factory. In Alabama, a migrant bean picker sees his life savings confiscated by police during a traffic stop. In Georgia, a rapist goes unpunished because his 13-year old victim is undocumented.

The southwest has traditionally been the home for most Latinos, but the Latino population in southern states is now the fastest growing, with many seeking low-wage jobs in manufacturing and construction. Since the 1990s the states of Arkansas, Alabama, Georgia, North Carolina, South Carolina and Tennessee have been privileged to add 1.6 million Latinos, mostly workers and their families. As with other Americans of color, these hardworking Latinos often face intense and

widespread hostility, discrimination and exploitation. They are routinely cheated out of their earnings and denied basic health and safety protections. They are regularly subjected to racial profiling and harassment by law enforcement. They are victimized by criminals who know they are reluctant to report attacks. And they are frequently forced to prove themselves innocent of immigration violations, regardless of their legal status. This treatment – which many Latinos liken to the oppressive climate of racial subordination that blacks endured during the Jim Crow era – is encouraged by politicians and media figures who scapegoat immigrants and spread false propaganda.

So much for a post-racial America. We might note that the principal discriminators are not named as white in any sentence in the 64-page report. Indeed, the world “whites” never appears in the report, and the only place “white” appears is in a few references to “white supremacist” groups. Even in critical research reports like this there seems to be an etiquette of not offending white dsciminators explicitly, but leaving the elite and ordinary white actors as “implicit” in the commentaries, unless they are part of supremacist groups. We see this in this next comment from the executive summary:

And as a result of relentless vilification in the media, Latinos are targeted for harassment by racist extremist groups, some of which are directly descended from the old guardians of white supremacy.

The report does recognize the problem is larger than these supremacist groups. Using general or vague language, local government “agencies” (again not named as white) are called out for discriminatory legislation being passed against immigrants, especially the undocumented:

A number of Southern communities, for example, have enacted ordinances designed to limit services to undocumented immigrants and make their lives as difficult as possible, with the ultimate goal of driving them away. In addition, many law enforcement agencies in the South, armed with so-called 287(g) agreements with the federal government, are enforcing immigration law in a way that has led to accusations of systematic racial profiling and has made Latino crime victims and witnesses more reluctant to cooperate with police. Such policies have the effect of creating a subclass of people who exist in a shadow economy, beyond the protection of the law.

Those who face discrimination have already endured many dangers and barriers in order to build up the South, to do the hard and dirty labor of

building skyscrapers in Charlotte, harvesting onions in Georgia, slaughtering poultry in Alabama and rebuilding New Orleans after Katrina. Many of these new arrivals left their homes in Mexico, Guatemala, Honduras and other Latin American countries to escape poverty, which some experts believe has been worsened by U.S. trade policies. Many crossed the border illegally, risking their lives and freedom for opportunity in the United States, while others were originally “imported” by employers under the guest worker system. Many others are legal residents or U.S. citizens, caught in the crossfire of America’s war on “illegals.”

Given this metaphorical “war” on them, it is not surprising that the interviewers found many Latinos living in great fear of the police and other government agents, as well as fear of cheating employers and criminals seeking to take advantage of them. In addition, as José Cobas and I have also found (see articles here, for example), it is not just the undocumented Latinos who face discrimination, mostly at the hands of whites. A great many Latinos face that discrimination:

Even legal residents and U.S. citizens of Latino descent say that racial profiling, bigotry and myriad other forms of discrimination and injustice are staples of their daily lives. “The assumption is that every Latino possibly is undocumented,” says one immigrant advocate in North Carolina. “So [discrimination] has spread over into the legal population.”

The racism is systemic, once again. And the relevant white discriminators need to be called out and named as principal actors in this sorry societal-oppression reality.

Racism in NYC Restaurant Hiring: Matched Study

A newly released matched study reveals racism in hiring patterns in New York City restaurants  (Creative Commons License photo credit: ktylerconk ).Busy lunch at Rue 57 Matched studies, like the one used in this research, are basically field experiments in which pairs of applicants who differ only by race (or sometimes gender) are sent to apply for housing, seek services or accommodations, or, in this case, apply for jobs.

In this study, economist Marc Bendick, Jr. sent pairs of applicants with similar résumés and matched for gender and appearance; the only difference in each pair was race.

Bendick found that white job applicants were more likely to receive followup interviews, be offered jobs, and given information about jobs, and their work histories were less likely to be investigated in detail than their black counterparts.

If you’re one of the many graduate students who read this blog and you’re contemplating what to do for a dissertation, consider a matched study.    We need more of them and this type of research gets well-reviewed in the top sociology journals.  Another recent matched study in sociology is the one that Devah Pager did for her 2003 AJS piece, “The Mark of a Criminal Record.” In this research, Pager matched pairs of individuals (again with similar résumés and matched on gender) applied for entry-level jobs—to formally test the degree to which a criminal record affects subsequent employment opportunities. The findings of her study reveal that a criminal record presents a major barrier to employment; and with regard to racism, Pager found that blacks are less than half as likely to receive consideration by employers, relative to their white counterparts.   Perhaps most disturbing in Pager’s research is the finding that black nonoffenders, that is African Americans with no criminal record, were less likely to get a job than whites with prior felony convictions.

Matched studies, such as the just released Bendick’s study of hiring in restaurants and Pager’s classic study of entry-level hiring of those with (and without) the mark of a criminal record, are important social science research for investigating the persistence of racial discrimination in hiring practices.
